Included in the below links is a brief synopsis of the Major Crimes Act, it’s evolution, the manner it which it has been employed, applied, and manipulated to further entrench and empower itself.
What may not be commonly known is that as an adjunct the commerce clause has been used to strip the nations of their ability of self determination as a sovereign people in much the same way it has when applied to the contentious issue of States Rights.
What’s even less likely to be known is that the major Crimes Act is singularly the result of an ancestor of Leonard Crow Dogs who committed murder.
No one is saying that Leonard Crow Dog has ever actually pulled the trigger on anyone himself, but he is at least by any legal standard complicit in the murder of Perry Ray Robinson Jr. and as grave keeper to the murder of others in unmarked graves at Wounded Knee.
It was Crow Dogs ancestor, a Brule sub chief, who murdered Spotted Tail and led to the Major Crimes Act of 1885 that transferred jurisdiction to the federal government over crimes such as murder, rape, manslaughter, and arson.
I don’t buy into the “sins of the father” thing, as such the grave keeper isn’t accountable for something an ancestor did-but it’s more than apparent the fruit didn’t fall far from the ancestral tree, and he surely is accountable for his own deeds.
The wiki link cites seven crimes that fall under federal jurisdiction, but the list has been expanded over the years and now includes fifteen.
