Those attempting to defend this violation of the 4th Amendment by saying it’s “legal”, “constitutional” as defined by questionable interpretations are themselves of a questionable nature.
I would remind “Legal” is only as good as the law it is based upon or any kangaroo court that says it is.
Storm troopers and the Gestapo were “legal” at one point in Germany- it was “legal” in this country to deny women and indigenous people the vote.
It was “legal” for children to work in mines and sweat shops.
It was “legal” to imprison people who couldn’t pay their debts, and becoming that way again.
“Legal” has covered a multitude of sins, far too many to enumerate, and now it is “legal” to destroy the Constitution and Bill of Rights.
Treaties between the nations and this country were “legal” even while criminal in their intent, as has been the routine violation of them.
Other examples of “legal” have been the Japanese internment camps during WW2, the reservation system designed to confine indigenous people.
It’s also “legal” to suspend Habeas Corpus-something considered so important as to be included in the body of the Constitution itself rather than the Bill of Rights.
I’ve attempted to take the middle ground, to point out the accountability for all this is a shared one, not singularly Bush’s or Obama’s, and believe that is the way of it-but following the in your face latest revelation that the NSA can and does listen in on calls and who knows what else without a warrant I say Obama needs to go, accompanied by a large number of individuals on both side of the aisle if he and they haven’t the integrity to stand up and defend what belongs to every man, woman, and child in his country.
The fact that Bush was able to hang on is a poor excuse for allowing Obama to and an argument not worth entertaining.
I say this not as a Democrat, Republican, or Tea Party member as I would never affiliate myself with any political party-that is known as independence, no script or talking points to follow, no need for approval and a pat on the back.

In a recent email exchange ( no doubt monitored) a friend made the following observation, if they would like to add additional commentary I would welcome it:

I’m just another one of those raggedy ass Indians that every effort has been made to disenfranchise, well aware that there are those who think we should just put our head down and shut our mouth-but even I can see the threat this poses, where it’s going.
The only recourse as nations we have to redress grievances is in the courts-courts where the “rule of law”, the Constitutionality of laws, is said to be paramount-when this standard is abrogated we are at a greater disadvantage-something we need to be aware of and take a position about.

I’m not willing to engage in any internet romantic imagery about who and what the nations are- I’m not going to stick a feather in my hair and pander to such expectations. I’m not a pipe carrier, a chief, a medicine man, or claiming to be a warrior.
What I am is a human being whose people have lost enough freedom as it is.
